By accessing and using WinGram, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

WinGram is an AI-powered mobile application designed to help single men optimize their Instagram profiles to attract better romantic attention. The app provides personalized recommendations, persona makeovers, caption rewrites, and aesthetic direction.

3. User Accounts

To use our service, you must:

• Be at least 18 years of age

• Provide accurate and complete information

• Maintain the security of your account

• Accept responsibility for all activities under your account

4. Content and Conduct

You agree not to use the service to:

• Upload harmful, offensive, or inappropriate content

• Violate any applicable laws or regulations

• Infringe on the rights of others

• Attempt to gain unauthorized access to our systems

4A. User-Uploaded Content & Third-Party Data

4A.1 No Platform Connection

Important: WinGram does not connect to, access, or retrieve data from Instagram or any other social media platform. All content in the app is voluntarily uploaded by you.

4A.2 Voluntary Uploads

When you use WinGram, you may voluntarily upload:

• Screenshots of social media profiles, messages, or interactions

• Photos that may contain third-party individuals

• Usernames, handles, nicknames, and other identifiers

• Personal notes about your interactions with others

• Any other content you choose to share

4A.3 Third-Party Content in Uploads

You acknowledge and agree that:

• Your uploaded screenshots may incidentally contain personal information of third parties (profile pictures, usernames, messages, etc.)

• WinGram processes this third-party data solely as part of analyzing content you chose to upload

• WinGram does not contact, identify, or independently profile these third parties

• This data exists in our system only because you voluntarily uploaded it

4B. User Consent, Rights & Responsibilities

4B.1 Your Representations and Warranties

By uploading any content to WinGram, you explicitly represent, warrant, and confirm that:

• You have the legal right to upload and share all content you provide

• You understand that your uploads may contain personal information of third parties

• You accept full and sole responsibility for all content you upload

• You will not upload content that violates privacy rights, intellectual property rights, or any applicable laws

• You will not upload illegal, harmful, defamatory, or inappropriate content

• You understand the content is used solely for your personal analytics and reflection

4B.2 Consent Acknowledgment

By using the upload features of WinGram, you:

• Confirm you understand and accept responsibility for sharing screenshots and content with WinGram

• Acknowledge that uploaded content is processed to help you assess conversation quality, engagement patterns, and social dynamics

• Agree that your data is for personal use only and will not be shared publicly or sold

• Accept that WinGram is not liable for content you voluntarily choose to upload

4B.3 User Liability

You agree to indemnify, defend, and hold harmless WinGram, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms

• Content you upload or share through the service

• Your violation of any third-party rights, including privacy or intellectual property rights

• Any misuse of the service

4C. No Instagram Affiliation

Disclaimer: WinGram is an independent application and is not affiliated with, endorsed by, sponsored by, or connected to Instagram, Meta Platforms, Inc., or any of its subsidiaries or affiliates.

WinGram does not:

• Access or use Instagram's API, servers, or systems

• Retrieve data directly from Instagram accounts or servers

• Have any official partnership, sponsorship, or business relationship with Instagram or Meta

• Claim or imply any endorsement by or connection to Instagram or Meta

Instagram® and Meta® are registered trademarks of Meta Platforms, Inc. References to Instagram in our app are purely descriptive, indicating the type of social media content our users may choose to voluntarily upload and analyze (screenshots they take themselves).

5. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

6. Subscription Terms

WinGram offers the following subscription options:

• Weekly: $8.99 USD per week

• Monthly: $29.99 USD per month

• Annual: $99.99 USD per year

Subscription pricing may vary by region and currency. Actual pricing will be displayed in the app before purchase.

7. Payment and Auto-Renewal

All subscriptions are processed through Apple's In-App Purchase system:

• Payment will be charged to your Apple ID account at confirmation of purchase

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase

• Any unused portion of a free trial period will be forfeited when you purchase a subscription

8. Cancellation Policy

You can cancel your subscription at any time:

• Go to Settings on your iOS device

• Tap your name, then tap Subscriptions

• Select WinGram and tap Cancel Subscription

• Your subscription remains active until the end of the current billing period

• No refunds are provided for the unused portion of any subscription period

9. Refund Policy

All purchases are subject to Apple's refund policies:

• Refund requests must be submitted to Apple, not WinGram

• To request a refund, visit reportaproblem.apple.com

• Refunds are granted at Apple's sole discretion

• WinGram does not control or guarantee refund approvals

10. Free Trial (If Applicable)

If we offer a free trial, you will be notified before subscribing. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You must cancel at least 24 hours before the trial period ends to avoid being charged.

11. Limitation of Liability

WinGram provides recommendations and suggestions but cannot guarantee specific outcomes in your dating life. The service is provided "as is" without warranties of any kind.

12. Intellectual Property

All content, features, and functionality of WinGram are owned by us and protected by copyright, trademark, and other intellectual property laws.

You agree not to:

• Copy, modify, or distribute our content without permission

• Reverse engineer or attempt to extract source code

• Use our service to create competing products

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason. Upon termination, your right to use the service will immediately cease. Paid subscriptions are non-refundable except as required by law.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or use of the service will be resolved in accordance with applicable law.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the app.
